Will my salary be deducted if I take maternity leave? National regulations on maternity leave in 2022

Pregnant women need to go for prenatal checkups on time every month during pregnancy. However, many working pregnant women need to take extra leave for prenatal checkups. So will wages be deducted for taking prenatal checkup leave? What are the national regulations for maternity leave for pregnant women? What should be done if the company does not implement national regulations?

Will wages be deducted for prenatal checkups?

Normal prenatal checkups for pregnant women should be treated as attendance, and wages cannot be deducted. According to Article 7, Paragraph 3 of the "Regulations on Labor Protection for Female Employees" issued by the State Council, it is clearly stated that the time required for a pregnant female employee to undergo a prenatal checkup during working hours shall be included in the working hours. Prenatal checkups for female employees should be treated as attendance, and cannot be treated as sick leave, personal leave, or absenteeism. For female employees on the front line of production, the production quota should be reduced accordingly to ensure time for prenatal checkups.

Therefore, normal prenatal checkups for pregnant women are protected by national laws and should not result in salary deductions. If there is any violation of the law, you can file a complaint with the labor administration department.

Maternity leave national regulations 2022

The state stipulates that female employees are entitled to maternity leave after pregnancy. Within the prescribed scope, pregnant women going to the hospital for maternity check-ups are treated as normal attendance. The specific regulations are as follows:

During the first to sixth months of pregnancy, you can enjoy one day off each month for pregnancy confirmation and health training, etc.;

During the 6th and 7th months of pregnancy, you can enjoy 1 day of leave each month;

In the 8th month of pregnancy, you can enjoy 2 days of vacation per month;

If the pregnancy is more than 9 months, you can enjoy 4 days of leave per month, but 2 days of leave are included in the pre-maternity leave.

Is there a limit on the number of maternity leave you can take?

The country does not have unified regulations on the number and number of days of maternity leave.

Article 6 of the Special Provisions on Labor Protection for Female Employees only stipulates that pregnant female employees can undergo prenatal examinations during working hours, and the time required shall be included in working hours. However, according to this article, it is believed in practice that as long as it is a normal and necessary prenatal examination, it should be included in working hours, and it cannot be calculated according to sick leave, personal leave, maternity leave, absenteeism, etc. Maternity leave is taken according to the doctor's advice. As long as the doctor believes that there is a necessary examination, it must be done, and the employer should provide relevant convenient conditions. So you can take the card you have opened in the hospital to apply for leave, and the date of your next maternity leave will be noted on it.

What are the rights of pregnant women?

It is important for pregnant women to understand their rights. So, in addition to prenatal check-ups being treated as attendance, what other rights do they have?

1. Not being fired During pregnancy, expectant mothers have the right not to have their wages reduced, not to be fired, or have their labor contracts or service agreements unilaterally terminated by the employer. They cannot be fired even if they return to work after giving birth. The Law on the Protection of Women's Rights and Interests and the Special Provisions on Labor Protection for Female Employees have clear provisions.

2. Maternity leave. According to Article 7 of the Special Provisions on Labor Protection for Female Employees, female employees are entitled to 98 days of maternity leave, including 15 days of prenatal leave. If the delivery is difficult, the maternity leave is increased by 15 days. If the birth of multiple babies is more than one baby, the maternity leave is increased by 15 days for each additional baby. Since 2016, there have been corresponding changes in marriage leave and prenatal check-ups, which are based on the regulations of the city where the employee is located.

Health Tips: The state stipulates that wages will not be deducted for prenatal checkups, but it is not certain whether the employer will follow the regulations. Pregnant women should understand their relevant rights and interests. If your rights are violated, you can negotiate with the employer first. If that doesn't work, you should learn to use legal means to protect your rights and interests.
